Stewart Title can offer tailored sessions for property lawyers covering the practical issues that arise when advising clients on title insurance; including introducer/adviser distinctions, Demands and Needs statements, advising on existing policies, reporting to clients, problems with disclosure and common compliance traps.

The session will cover questions such as:

• When are you simply identifying a possible need for title insurance, and when might you be going further?
• What are the risks when dealing with existing policies, top-ups, or policies arranged by the other side?
• What should a proper Demands and Needs statement look like?
• How do you explain why a particular policy or insurer has been recommended?
• How to report to clients on how title insurance practically helps them?
• What should clients need to understand about cover, disclosure, limitations, and the fact that insurance gives financial comfort rather than removing the underlying title issue?
• What should be recorded on file?

As you know, it is a requirement of the SRA, CLC and FCA that lawyers who arrange Title Insurance should have regular training on these matters.

This session will be run by Director of Partnerships, Robert Kelly. Before joining Stewart Title, Robert was a Property lawyer for over 25 years dealing with both Residential and Commercial Property.
